Trademark Registration in India: Protect Your Brand, the Right Way

Built a name customers recognise, but not sure it is legally yours, or whether someone else has already filed it?

A registered trademark gives you the exclusive right to use your brand name or logo for your goods or services, and the right to act against copies. Small enterprises with Udyam Registration and recognised startups pay a lower government fee. GRO-MSME helps you search, choose the right classes, file and follow up, and put the key business agreements in place.

Trademarks are examined and registered by the Trade Marks Registry under the Controller General of Patents, Designs and Trade Marks. GRO-MSME provides application and documentation support; it cannot guarantee registration, and contested matters need an advocate.

What Is Trademark Registration?

Trademark registration is the legal registration of a brand name, logo, slogan or other mark under the Trade Marks Act, 1999, for specific classes of goods or services. In India, applications are filed on Form TM-A with the Trade Marks Registry, usually online through IP India. The government e-filing fee is ₹4,500 per class for individuals, startups and small enterprises and ₹9,000 per class for others. A registered trademark is valid for 10 years and can be renewed indefinitely. You can use ™ once you file; ® is used only after registration.

How Does Trademark Registration Work?

  1. Search

Search the IP India trademark database for identical or similar marks in your classes before filing.

A good search is the best protection against objection and opposition later.

  2. Choose classes

Goods and services are grouped into 45 classes; you file in each class your business uses.

  3. File Form TM-A

File online with the mark, applicant details, classes, description of goods or services and the date of first use (or “proposed to be used”).

  4. Examination

The Registry examines the application and may issue an examination report with objections.

  5. Reply and hearing

Objections are answered in writing, and a hearing may be scheduled if needed.

  6. Publication and opposition

Accepted marks are published in the Trade Marks Journal; anyone may oppose within four months.

  7. Registration

If there is no opposition, or it is decided in your favour, the registration certificate is issued.

Trademark Registration: Frequently Asked Questions

What is the fee for trademark registration in India?

The government e-filing fee on Form TM-A is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others. Physical filing costs more. Professional fees, if any, are separate.

How long does trademark registration take?

It depends on examination, objections and any opposition. After acceptance, the mark is published in the Trade Marks Journal and anyone can oppose within four months. Straightforward applications take several months; contested ones take longer.

How long is a trademark valid in India?

A registered trademark is valid for 10 years and can be renewed for further periods of 10 years each, indefinitely.

Can I use ® after filing my trademark?

No. You can use ™ after filing, but ® only after the trademark is registered. Using ® for an unregistered mark is an offence.

How do I check whether a trademark is already registered?

Use the public trademark search on the IP India website, searching by word and by class. Similar-sounding or similar-looking marks in related classes can also cause objections.

Do MSMEs get a lower trademark fee?

Yes. Small enterprises can file at ₹4,500 per class, half the standard e-filing fee, with proof such as the Udyam Registration certificate. Recognised startups and individuals get the same fee.

Can GRO-MSME register my trademark?

GRO-MSME helps you search, file and follow up through Early Grow Advisory Services, but registration is granted only by the Trade Marks Registry. Contested oppositions or litigation need an advocate.
